I beg to refer to your letters signed Alter Vous K8RBK/49x & 25th October 1916 and 177A/46x of 1st November 1916 addressed to the Prince Line Ltd. in which you indicated that as the proceedings in the Manila Court with regard to forfeiture of bond were still pending, the time had not yet arrived for a decision on the question of compensation by the Government and that Owner's claim would not be prejudiced by its standing over. I now beg to inform you that the Manila proceedings were completed some time since with the result that the Prince Line have sustained a net loss of £2510.7.2 for expenses and of £5769.0.2 for loss of time, making altogether the sum of £8279.7.4, and for this amount they now ask that they may be compensated.

Shortly, the facts of the matter are that this vessel was loading in New York for the Philippines in April 1916. At that time no Statutory List with regard to the Philippines was known to have been published.

On the 3rd April I learned from the papers that there was such a list. I immediately called on you and learned that trading with certain firms in the Philippines and also in the Dutch East Indies had been prohibited. I thereupon telegraphed to the representatives of the Conference in New York informing them I had ascertained from you that a list of the firms had been mailed to the British Consul at New York and instructing the agents to get this information from the Consul. This cable was followed up by a list of the prohibited firms sent by me on the 6th April.

The Agents in New York acted upon the instructions sent to them and applied to the British Consul but the list was not procurable there until the 10th April by which time the bulk of the vessel's cargo was already on board. There was no alternative but for the vessel to sail which she did and on arriving at Penang a number of parcels for Manila, Cebu and Iloilo were ordered by H.M. representative to be discharged there, it being alleged that the cargo was for the German firms of Behn Meyer, Viegelmann, Froelich & Kuttner and Roensh.

The vessel was delayed for 7 days on account of this and considerable expense was incurred. The vessel proceeded to Manila and on account of incorrectness in formalities and consequence of the missing cargo and the ... made ... in ...
